If you own an HDB flat, you likely know that you are not allowed to sell it until you have met the Minimum Occupation Period (MOP). The MOP is the required duration you must physically occupy your flat before you are permitted to sell it on the open market.
However, certain life circumstances, such as divorce or avoiding bankruptcy, may necessitate selling your HDB flat before the MOP is fulfilled. You can appeal to the HDB to sell your flat early, and here’s how.

What is the Minimum Occupation Period (MOP) for HDB Flats?
The Minimum Occupation Period began in 1971 and takes effect from the date the owner receives the keys to their new home. Most HDB flats, including resale flats and those under the Selective En bloc Redevelopment Scheme (SERS), are subject to a 5-year MOP. However, keep in mind that any time you spend overseas will not be counted towards your MOP.
For example, if your job requires you to live overseas for a year within the 5-year physical residency requirement, your MOP will be automatically extended by one year. This is because the year spent abroad will not be included in the calculation of your MOP.
You can check the remaining time on your MOP by logging into HDB’s e-Services portal with your Singpass.
Renting out the entire flat before your MOP is fulfilled is also not allowed. However, you can rent out individual rooms as long as you adhere to the maximum occupancy and minimum rental period stipulated by HDB. Otherwise, you risk having your HDB flat confiscated.
⚠️Please note that the Minimum Occupation Period for the Prime Location Public Housing (PLH) model is 10 years. For flats purchased under the Fresh Start Housing Scheme, homeowners will be required to live in their homes for 20 years. For more information on the respective MOPs required for different types of HDB flats, you can consult the Housing & Development Board (HDB).
Under What Circumstances Can You Appeal to Sell Your HDB Flat Before the MOP?
Life rarely goes according to plan, and under extenuating circumstances, you may need to sell your HDB flat before the MOP is up. For situations like divorce, bankruptcy, or loss of citizenship, you can file an appeal with HDB to sell your home before the MOP.
#1: Divorce and Transfer of Ownership

Divorce is one of the most common reasons homeowners choose to sell their HDB flat before reaching the MOP. While it may be more practical for one or both owners to retain ownership of the flat until the MOP ends, selling the flat often provides better closure for both parties.
Lawyers will typically encourage one party to take over ownership of the HDB flat if they are financially capable and qualify under the Single Singapore Citizen Scheme. However, if you ultimately decide to return the flat to HDB, you can appeal to them by submitting the relevant documents for approval via HDB’s e-Feedback form. This includes:
- Court order (if applicable)
- One of the following:
- Writ for Judicial Separation (formerly known as Deed of Separation)
- Certificate of Muslim Divorce
- Interim Judgment and Certificate of Making Interim Judgment Final (formerly known as Decree Nisi and Decree Nisi Absolute)
All documents must be accompanied by an official English translation if they are not written in one of Singapore’s four official languages (English, Mandarin Chinese, Malay, and Tamil). Finally, both parties should also reach an agreement on how to best distribute the profits or losses before deciding to sell.
#2: Avoiding Bankruptcy

Bankruptcy includes situations where the family’s sole breadwinner becomes incapacitated due to accidents, death, and other related reasons. However, this also depends on whether HDB deems the remaining family members capable of working to provide sufficient funds to sustain the household. But if you can avoid declaring bankruptcy by selling your HDB flat and downsizing to a cheaper one, you can submit the relevant documents proving your current financial situation to HDB’s appeal portal.
#3: Renouncing or Losing Citizenship

Non-citizens are not eligible to purchase an HDB flat unless they are applying under the Non-Citizen Spouse Scheme. Therefore, if all homeowners decide to renounce their Singapore Citizenship and/or Singapore Permanent Resident (PR) status to move overseas permanently, HDB may allow you to sell your home and have all your Central Provident Fund (CPF) returned.
How to Increase the Chances of Selling Your HDB Flat Before the MOP?
While MOP waivers are generally at HDB’s discretion, there is evidence that HDB is flexible and understanding towards families in exceptional situations. Officially, HDB has approved the sale of 5,000 pre-MOP flats between 2015 and 2020 for reasons including financial hardship, divorce, or the owner’s death.
So, while there’s no foolproof way to guarantee you’ll get an MOP waiver, ensure you have all your documents ready, follow up regularly, and be clear in your appeal about why you need to sell your HDB flat.
How to Submit an Appeal to Sell Your HDB Flat Before the MOP
That being said, such appeals are handled on a case-by-case basis. You can either (1) visit an HDB branch to submit your appeal or (2) log into your My HDBPage: Log in via SingPass > My Flat > Purchased Flat > Flat Details.
After clicking “Flat Details,” you should be able to find the contact information of the property manager in charge of your block. Draft a letter stating your reasons for intending to sell your HDB flat before the MOP and mail it to that address. Additionally, you can try to expedite the process by contacting your Member of Parliament (MP). Ultimately, however, the decision lies with HDB. So, we hope you get what you wish for.
